Description

Students will read excerpts from Justice Clark's majority opinion and Justice Harlan's dissenting opinion on Mapp v. Ohio regarding the 4th Amendment, search and seizure, and the exclusionary rule/principle. They will then answer 16 questions of varying degrees of difficulty. The answers are included where appropriate and this would be great for a sub! 

Sample questions include:
--How is the 14th Amendment connected to this case?
--What does Clark identify as “logical?”
--Explain the “mutual obligation” had by the federal and state governments.
--What does Harlan identify as an initial problem with the decision of this case? 
--Compare and contrast Clark and Harlan’s perceptions of what was actually decided in this case.
--Why don’t you think this was a unanimous case?
