Description

Students will read excerpts from Chief Justice Warren's majority opinion on Miranda v. Arizona regarding the 5th Amendment, excerpts from Justice Harlan's dissenting opinion, answer 20 questions and complete one creative task. The answers are included where appropriate and this would be great for a sub!

Sample questions include:
--Why do you think Warren referred to the items in the 5th Amendment as “precious rights” rather than privileges?
--Explain the meaning of the phrase, “the States, with one accord.”
--Does Warren agree with an individual waiving their rights and speaking to police, why or why not?
--Summarize the main point of Warren’s final paragraph.
--Explain what Harlan’s immediate dissent is regarding the majority opinion.
--Where does Harlan see misinterpretation, or misapplication, of the Constitution? Do you agree, why or why not?
--What does it imply, or show, that this case was decided so narrowly (5-4)?
--Were you more persuaded by the Majority or Dissenting opinion and why?
