Description

Students will read excerpts from Justice Black's majority opinion on Gideon v. Wainwright regarding the 6th Amendment, as well as excerpts from the concurring opinions of Justices Harlan and Clark. They will then answer 18 questions of varying degrees of difficulty. The answers are included where appropriate and this would be great for a sub! 

Sample questions include:
--Under what circumstance(s) could a defendant be present without counsel?
--Of the first 10 amendments not referenced, might any have those been also not been considered fundamental rights, why or why not?
--What can hold America back from living out its “noble ideals” and why?
--Explain the relevance of Harlan’s discussion of capital and noncapital cases.
--How is Harlan’s excerpt most similar to Black’s and where is it most different?
--Should this be considered a landmark case, why or why not?
