Description

Students read excerpts from the majority and dissenting opinions of Justices Brown and Harlan from the Supreme Court Case Plessy v. Ferguson (separate but equal) and answer 20 questions of varying degrees of difficulty. This would be great for a sub and the answers are included where appropriate.

Sample questions include:
--Did Brown believe the 13th Amendment had been violated, why or why not?
--Where does Brown see inferiority originating from?
--This case established the “separate but equal” mindset. Which part of Brown’s opinion most illustrates that and why?
--Which of the Bill of Rights might Brown have taken into consideration in his ultimate ruling and why?
--Explain Harlan’s two takes on race relations in America. How could such thoughts coexist?
--What does it say, or imply, about America in 1896 that there was a single dissenter in this ruling?
--Explain the long term implications of this case for civil rights and race relations.
